UBS whistleblower verdict thrown out despite US Supreme Court win

  • A former UBS bond strategist who persuaded the U.S. Supreme Court to make it easier for corporate whistleblowers to win retaliation lawsuits suffered a setback on Monday, as a jury verdict awarding him back pay and other damages was thrown out.

The U.S. Supreme Court ruled in favor of UBS whistleblower Trevor Murray, affirming that whistleblowers under the Sarbanes-Oxley Act do not need to prove their employer's retaliatory intent. However, despite this victory, a New York federal judge dismissed Murray's $1.7 million award, stating that the jury instructions were flawed as they did not require proving UBS's intent to retaliate. This decision came after the Supreme Court clarified that whistleblowers only need to show that their protected activity was a contributing factor in the adverse employment action, not that the employer intended to retaliate. The case has been remanded for further proceedings, leaving the possibility open for Murray to potentially recover his award if the case is retried with correct instructions.
