(aMF Globala or the aCompanya) (OTC: MFGLQ) between November 5, 2009 and October 31, 2011, inclusive (the aClass Perioda), seeking to pursue remedies under the Securities Exchange Act of 1934. The class action lawsuit was filed in the United States District Court for the Southern District of New York.
MF Global was one of the worldas leading brokers in markets for commodities and listed derivatives. The Complaint alleges that during the Class Period defendants misrepresented and/or failed to disclose material adverse facts concerning MF Globalas business, operations and financial prospects, including that: (i) the Company was suffering from serious liquidity pressures based on its exposure to the European debt crisis; (ii) the Company's internal controls were highly deficient and were unable to clearly segregate clientsa funds; and (iii), the Company's true risk profile would inevitably lead to a credit rating downgrade.
